Regulatory - We deliver clear advice to navigate through the complex legal requirements of compliance and to create policies and procedures to compliment the client's business goals. We seek creative solutions and use our negotiating skills to achieve cost-effective resolutions and avoid litigation or other legal proceedings, whenever possible.
Litigation - When litigation in necessary to resolve disputes, we represent clients before federal and state courts and regulatory agencies. Our attorneys regularly litigate traditional environmental issues of site remediation, liability allocation, third party claims of toxic exposure, land use approvals, and insurance coverage. Land Use litigation attorneys at the Firm are specialized in ensuring that clients are permitted to take full advantage of applicable law.
We are trusted with environmental work for some of the largest and most active Fortune 500 companies in the United States. Our attorneys coordinate the environmental assessment process by taking a team approach with our real estate attorneys and in-house counsel, by interacting with outside environmental consultants to properly analyze the complexity of environmental issues associated with purchasing, selling and managing all types of real estate. We have extensive experience in the attainment of incentives allowed under Brownfield laws and related State and Federal programs. Our goal is to eliminate or minimize the potential liabilities associated with the transactions by fully informing our client of the risks and the benefits from a legal perspective and, more importantly, from a practical perspective.
Dawda Mann assists clients confronting questions of liability and compliance involving the full range of environmental laws including CERCLA, RCRA, CAA, CWA, NEPA, NREPA and TSCA. Our ability to counsel clients who need expertise in the complexities of environmental law is a result of our long history in this field, experience that most law firms do not have.
This practice group is skilled at counseling clients on all regulatory aspects of managing waste and products containing hazardous substances. We regularly assist clients in the attainment of operating permits and the pursuit of regulatory appeals in the event the permitting agency wrongfully denies the permit requests or seeks to impose improper terms.
